24 Haziran 2016 “4. GAR Live İstanbul Konferansı”

24 Haziran 2016 Cuma günü Global Arbitration Review (GAR) organizasyonuyla düzenlenecek olan 4. GAR Live İstanbul Konferansı, İstanbul Tahkim Merkezi Tahkim Kuralları’nı konu alacaktır. “4th Annual Gar Live Istanbul: Introducing the ISTAC Rules” adıyla gerçekleşecek bu konferansta, tahkimin duayen isimleri İstanbul’da buluşacaktır.

İstanbul’un tahkim zirvesi niteliğini taşıyan konferans hakkında ayrıntılı bilgi ve kayıt koşullarına, GAR’ın web sitesi üzerinden ulaşabilirsiniz.

9.10: Session one – An introduction to the ISTAC Rules

This session will unveil and then discuss the Istanbul Arbitration Centre (ISTAC)’s rules. It will explain those rules and how they fit in with relevant developments – local and international.

Subjects the panel will discuss include:

  • The nature, purpose and operation of the ISTAC Rules
  • The agreement to arbitrate under ISTAC Rules: how to draft a standard ISTAC clause, and the use of model clauses
  • Commencing arbitration – initial considerations including the option of expedited proceedings
  • Constituting the tribunal – the requirement for impartiality and independence
  • Controlling time and cost – what timetables are set out within the rules, and how is the tribunals remit defined (terms of reference)?

14.00: Session three – Investment arbitration: What are the most important developments of the past year from a Turkish perspective?

From Yukos, to mega treaties, to how exactly one enforces an ICSID award in the US: it’s been a year full of developments in investment arbitration. But which of the many developments and decisions should Turkish practitioners be most alive to? In this session, a leading panel will offer a high speed update on the year just gone, and which aspects matter – and why

Developments the panel are expected to discuss include:

  • Which cases and other developments will have the greatest impact within Turkey?
  • Can investment arbitration help companies affected by regional politics (cancelled contracts etc)? What are the prospects for success?
  • What lessons should claimants learn on how to best position themselves for success?

16.00: Session four – The use of witnesses in arbitration: Do’s and don’ts

Turkish lawyers don’t deal with witnesses (fact or party-appointed experts) in the ordinary course of things – domestic litigation. So encountering the use of them, in IA, can be a shock – and a challenge.

This session will seek to dispel some misconceptions that novices have when it comes to the use of witnesses in cases, and will then explore best practice including what’s allowed and not allowed – in different legal systems, plus some of the do’s and don’ts that make up the art of cross examination.

Finally, it will examine the value of some new procedural techniques: hot-tubbing etc.

It will open with a short presentation on the ISTAC rules and what they permit when it comes to witness testimony.

Subjects the panel are expected to explore in detail include:

  • best practice in cross examination (counsels’ perspective; arbitrators)
  • the pros and cons of party appointed expert vs tribunal appointed
  • hot tubbing and other innovations intended to make use of party-appointed more efficient
